Is it Illegal to make a fan game?

I'm thinking of making a fan game based on a certain little indie game, which is NOT Undertale btw. And, I'm extremely paranoid, would it be illegal if I were to make a fangame based on, say Hotline Miami or [insert random indie game]? I know there are plenty of fangames that are based on the Five Nights at Freddy's franchise(screw that game :|) but I just want to be sure.

This question is raised so often around here, I'm surprised people still ask.  The answer is "no".  It is NOT illegal.  It's perfectly fine... if you do it properly.


Just don't use copyrighted and/or trademarked aspects of the original game.  For example, you should NOT copy things like artwork (sprites, backgrounds) and music.  And you should avoid using distinct names for characters and places (like Princess Zelda, for example).


But if you make your own art and music, and create your character and place names, you're fine.  Here's an interesting article on Gamasutra about fan games and clones.
