If I am to make a game in GMHTML5 am I free to publish/make money from it wherever I want? Or do I have to publish through YYG?

Also does it differ between different versions of GM?

You have zero obligation to publish through YYG on any version. You can commercialize it any way that isn't prohibited in the TOS/Game License.

Ok thanks! So just to be clear YYG are never entitled to any of my profits no matter what version of GM I use?

No, just make sure all content is yours, and or you have states permission from the publishers. Otherwise you might find yourself in court.

a. the versions of the Software described as “Beta” or “Demo” for personal, non commercial, evaluation use only;


From the GameMaker EULA.

Until GM:HTML5 is out of beta you can't use it commercially. (I'm not sure when it counts as out of beta tbh, is it when the price changes?)

That's from an old License agreement. The last update 1.0.200 (at least) had this removed - you need to update. You are free to sell you HTML5 creations as you see fit.

This is what I have on my install (1.0.208):

1. Scope

1.1. Subject to these terms you may install and use:
the versions of the Software described as "GameMaker" for personal, non-commercial and commercial use; provided you have paid the applicable licence fee.
In each case "use" of this Software shall be to create computer programs ("Stand-alone Applications").
The Stand-alone Applications you create with the Software may be used by you as you wish without payment of any licence fee or royalty PROVIDED THAT such Stand-alone Applications comply with these Terms including without limitation as set out in clause 3 below.


I have the latest update, that's the EULA on the wiki.

Is that what people rely on nowadays? That Wiki has been neglected for ages, and besides I just cannot comprehend why most people refuse to read local documentation. Go to Start Menu -> GameMaker-HTML5 1.0 -> GameMaker-HTML5 1.0 License for the latest EULA, it clearly does not include the clause that you cited.

besides I just cannot comprehend why most people refuse to read local documentation.


I don't refuse to read it, I didn't know where the GM license was stored by heart, so I read an EULA from the official YoYoGames website. Forgive me for thinking it would be in date.

Haha, to true. I once read on wiki that all cats enjoyed to eat oranges whole. :D Wonder what the human mind can come up with next when bored.
